Big Net South’s role
as your ISP
-
Big Net South will make all reasonable efforts to provide access to
the Internet for its customers.
- Big Net South
will establish policies designed to provide quality service
for the Big Net South customer base.
- Big Net South
does not warrant or guarantee any product or service acquired
either directly or indirectly through the Internet.
- Big Net South will
not filter any information accessible through the Internet unless you have subscribed to our filtered service.
- Big Net South will
from time to time monitor activity to enable it to continue
to provide quality service.
- Big Net South will
disclose any information necessary to satisfy any law enforcement
agency request.
- Big Net South will
not intentionally disclose any personal information unless required
by law.
Customer's role
as an Big Net South subscriber
- Customer agrees that it is the sole responsibility of the customer to determine if using any access number provided by Big Net South is a local call or long distance call. Big Net South shall not, in any case, be responsible for a customer's local telephone charges or long distance telephone charges.
- Customer
will not engage in any activity that violates any federal, state,
or local law.
- Customer
will not harass or otherwise disturb other Internet users in
any way, using Big Net's hardware, software or network. This
includes unsolicited e-mails ("spam") or broadcasts.
- Customer
will not upload or distribute pirated software nor use any of
the various "bots" and scripts which are primarily used for the
distribution of pirated software. This includes, but is not
limited to, scripts such as eggdrop for irc.
- Customer
assumes total responsibility and liability for any products
or services acquired through the Internet.
- Customer
agrees that Big Net South is not liable for any product or service acquired
through the Internet that either directly or indirectly causes
a loss for the Customer.
- Customer
agrees that the customer has total responsibility for monitoring
the content of all information received through the Internet.
- Customer
agrees that Big Net South is not responsible or liable in any way for
material available through the Internet that some may consider
obscene or offensive.
- Customer
agrees that it is the customer's responsibility to review or
edit all material downloaded from the Internet and that Big Net South
is not liable for any losses sustained due to problems with
information or programs received through the Internet.
- Customer
agrees that Big Net South is not liable for any losses sustained by
Customer either directly or indirectly due to Big Net South loss of
ability to provide service due to any reason or negative situation.
- Customer
agrees that they will not attempt to access computer systems
or data that they are not authorized to access.
System Access
- Big Net South provides
a standard account for unlimited access per month. Unlimited access is defined as having access to our service 24/7. However,
this is not an account for a continuous 24 hours a day, 7 days
a week connection. If a continuous connection is more appropriate
for your needs please contact us about dedicated access service. We reserve the right to bill you for dedicated access or cancel your subscription if we find you are using the system excessively.
- Big Net South may logoff any user session
that is idle 20 minutes or more.
- Big Net South prohibits
the resale of any service that you purchase from Big Net South.
- Big Net South prohibits
the display of any material that violates the law or is offensive
or obscene in any Web site hosted on equipment belonging to
Big Net South.
- There
is a 10 cents per minute charge associated with the use of our
800, 888, or 877 numbers for dial-up access. No credits will be given for
use of this service, even if use was inadvertent.
Shell Accounts
- Big Net South customers
are allowed 10 MB of storage space for a personal website. Customers
found to have over 10 MB of files in their shell account will
be charged a fee of $1 per MB over the 10 MB limit each month.
- This space
is provided for personal use only. Any person interested in
a business site should contact our sales department. Any website
found that offers products or services or appears to be a commercial
site in any way will be removed from our server at our discretion.
- Big Net South does
allow customers to write their own cgi scripts for their personal
websites. If you would like to use cgi scripts on your personal
web site, email hostmaster@bignetsouth.net or call Customer Care to
have a cgi-bin directory set up for you.
- Big Net South reserves
the right to randomly check all cgi scripts for potential security
problems.
Payment for
Services
- Customer's
initial billing will include the first full month of service
and any applicable set-up fees.
- All bills
are due within 30 days from the date of invoice. A $5 late fee
will be charged on accounts that are past due. Customers with
past due balances could have service interrupted when their
account becomes 15 days past due. Service could be terminated
and all stored files erased if account becomes 60 days past
due. In the event of a disconnection due to non-payment, there
will be $10 reconnect fee. If an account reaches 90 days past
due, it could be turned over to a collection agency or an attorney
for collection.
- If a bank
draft is returned unpaid, the customer will incur an additional
$20 fee. Big Net South may terminate service until all fees are paid
to Big Net South. If Big Net South does not immediately terminate service it
in no way forfeits that right to terminate it when necessary.
- If a credit
card charge is declined for any reason, service could be interrupted
immediately until the charge is accepted or the account is paid
current by some other method. Big Net South is under no obligation to
resubmit the credit card charge after receiving notification
of a declined charge.
- If a check
is returned unpaid, the customer account will be charged a returned
check fee of $20. Service will be interrupted until the account
is paid in full, including a $20 returned check fee.
- Customers
are responsible for their fees regardless of their use of the
system. Once you are seven days into the initial billing cycle you will be
responsible for the entire month.
- Big Net South may
seek the service of various collection agencies for excessively
overdue accounts.
- Big Net South reserves the right to back bill any customer for services used, but not billed.
Cancellation
of Service
- Customers
may cancel their service by communicating in writing to Big Net South
at our office at 125 S. Congress Street,
Suite 1510, Jackson, MS 39201, or by email at billing@bignetsouth.net.
Set-up fees, if any, are not refundable. Big Net South will terminate
system access for the customer at the time the customer requests
cancellation of service.
- Big Net South reserves
the right in its sole discretion to terminate any subscriber's
service.
Modification
of User Policies and Procedures
- Big Net South reserves
the right to modify the policies and procedures. All Big Net South customers
agree to comply with the polices and procedures.
